This legal notice includes the general conditions governing access to and use of the website www.africanclimate.net, which is owned by the FP7 co-funded AfriCAN Climate Project (hereinafter AfriCAN Climate Portal).
The use of the website supposes the express and complete acceptance of these terms and conditions as published at the time the user accesses it, without prejudice to any special conditions that may apply to some of the specific services of the website.
Use of the website www.africanclimate.net
The website www.africanclimate.net provides access to a multitude of information, services, programs and data (hereinafter “content”) on the Internet to which the user can have access. The user accepts responsibility for the use of the website. This responsibility extends to necessary registration to access certain services and content. When registering, users will be responsible for providing true and lawful information. As a result of registration, the user can be given a password for which he/she will be responsible, undertaking to make proper, confidential use of it.
The user agrees to make appropriate use of the content and services that the AfriCAN Climate Portal offers by means of this website (such as good practices and publications) and, among other things, agrees not to use them for (i) taking part in activities that are illicit, illegal or contrary to good faith and public order; (ii) disseminating content or propaganda of a racist, xenophobic, pornographic or illegal nature, or advocating terrorism or infringing human rights; (iii) causing damage to the hardware and software systems of AfriCAN Climate Portal, its suppliers or third parties, by introducing or spreading computer viruses or any other hardware or software capable of causing the aforementioned damage; (iv) attempting to access and, as applicable, use the email accounts of other users and/or change or manipulate their messages.
User files and their content
The user acknowledges and accepts that he/she is solely responsible for the content he/she uploads to the website www.africanclimate.net and for the consequences of its publication. The AfriCAN Climate Portal is not responsible for the opinions expressed by users on the blog or other tools of participation, and are specifically exempt from all responsibility concerning user content, although the contents have been moderated.
The user represents and warrants that he/she is in possession (and will remain so while using the services) of all necessary licenses, rights, consents and permits required to allow AfriCAN Climate Portal to use his/her User Submissions for the provision of Services and for any other purpose in accordance with the manner contemplated by the website and in these Terms and Conditions.
The user agrees not to upload or post any User Submissions that are subject to intellectual property rights of third parties (including exclusive or publicity rights) unless the legal owner of those rights has granted him/her a license or formal authorization to publish the material in question.
AfriCAN Climate Portal reserves the right (but is not obliged) to decide whether the user files meet the content requirements set out in these Terms and Conditions, and may remove such user submissions and/or terminate the access of any user uploading user files that violate these Terms and Conditions of Service at any time, without prior notice and at its own discretion.
Intellectual and industrial property of the page’s content
All the elements that make up the website www.africanclimate.net, as well as the structure, design and source code thereof, and the elements contained in it (including but not limited to images, sound, audio, video, software or texts; trademarks or logos, color schemes, structure and design, selecting of materials used, computer programs necessary for its operation, access and use), are owned by AfriCAN Climate Portal. All rights reserved. This is without prejudice to the full ownership by the Collaborating Organizations of their own content, logos and brands. Users of the website may only make private, personal use of its content. The user undertakes to respect the intellectual and industrial property rights of AfriCAN Climate Portal. He/she may view the elements of the website and even print, copy and store them on the hard drive of their computer or any other hardware. It is absolutely forbidden to use the website or any of its elements for commercial or unlawful purposes. AfriCAN Climate Portal does not accept liability for the use by others of the content of the website and may exercise all civil or criminal actions applicable in the event of infringement of these rights on the part of the user.
In order to improve website performance, AfriCAN Climate Portal reserves the right, at any time and without prior notification to the user, to unilaterally modify, extend or suspend the presentation, configuration, technical specifications and services of the website. It also reserves the right to modify at any time the present conditions of use and any other special conditions.
AfriCAN Climate Portal is not responsible for any typographical, formal or numerical errors the website may contain, or the accuracy of the information contained therein. AfriCAN Climate Portal is not responsible, in any circumstances, for damages of any kind which may be caused by, but not limited to: errors or omissions in the content, non-availability of the portal or the transmission of viruses or malicious or harmful programs in the content despite having taken all the necessary technological measures to prevent it.

AfriCAN Climate Portal accepts no responsibility for the content, information or services that may appear on these sites, which are for the purpose of information only and in no case imply any relation between the AfriCAN Climate Portal and the persons or bodies owning this content or the sites on which they are located.
AfriCAN Climate Project is the owner of the website www.africanclimate.net and, in accordance with Organic Law 15/1999, of 13 December, on the Protection of Personal Data and its implementation, is required to protect the processing of personal data, civil liberties and fundamental rights of individuals who are users of our site or access our page, especially in relation to their honour and personal and family privacy. We have developed the technical requirements needed to ensure the confidential treatment of data, and prevent its loss, alteration and unauthorized access or misuse.
AfriCAN Climate Portal states that all personal information that is provided by means of online forms, e-mail and/or subscription to the website’s services will be treated in strict confidence as required by Law 15/1999 of 13 December, on the Protection of Personal Data. In this way, we guarantee that the said data is processed in keeping with the safety standards established by law, preventing its manipulation or use, and unauthorized access by third parties who may use it for purposes other than those that have been requested.
The data that may be requested of users of the website www.africanclimate.net is for the sole purpose of providing the services for which it is requested, and maintaining fluid communication with users by sending, by any means (postal or electronic mail, landline or mobile phones, SMS, MMS, Internet, etc.), information that is considered useful and the most important news about our activities. In any case, AfriCAN Climate Portal is the only recipient of the data and this information may be used to administer the website or carry out strictly confidential internal statistical studies.
The user guarantees that the personal information he/she supplies is truthful and accurate, and AfriCAN Climate Portal reserves the right to exclude from website services any users who provide false information, without prejudice to other actions stipulated by law.
